Terms and Conditions

1. Purpose and scope

These general terms and conditions of sale and booking (the “Terms”) govern bookings for holiday rentals (villas and furnished tourist apartments) made directly on the websitewww.frenchrivieragoldkeys.com, or directly with our team (by phone, email or WhatsApp), as well as the associated concierge services.

They do not apply to bookings made through third-party platforms (for example, Airbnb or Booking.com), which remain subject to those platforms’ terms and conditions.

By making a booking, you fully accept these Terms and Conditions, which the Client confirms having read before confirming the booking.

2. Service Provider Identification

The website and services are provided by French Riviera Gold Keys (FRGK), SIRET: 934 094 921 00012, whose office is at 31 Bd Vallombrosa, 06400 Cannes (hereinafter “FRGK” or “we”). Contact: contact@frgk.fr · +33 4 80 16 16 11.

The capacity in which FRGK acts for the property you booked is specified in your booking confirmation.

3. Definitions

  •  Client: an adult individual acting in a non-professional capacity, or a legal entity, who makes and is responsible for the booking.
  • Guests: everyone staying at the property, including the Client.
  • Accommodation: the villa or furnished apartment rented for the stay.
  • Confirmation: the document (email or message) summarising the booking: property, dates, number of guests, price, payment terms, security deposit, cancellation policy and check-in and check-out times.

4. Type of Rental

The rental is a seasonal furnished holiday rental, granted for a fixed term and for the exclusive use of temporary accommodation and holidays. It is governed by Articles 1709 et seq. of the French Civil Code and by the provisions of the French Tourism Code applicable to furnished holiday rentals. It may not under any circumstances be tacitly extended or confer on the Client a right to remain in the property.

The Client certifies that the accommodation is not being occupied as a primary residence. The same client may not rent the same accommodation for more than 90 consecutive days.

Where required, the property’s registration number is shown on its listing.

5. Booking

5.1 Process

The Client selects a property, dates and number of guests, then provides the requested information. Before confirming, they can review their booking summary and total price, and correct any errors.

The booking is confirmed upon receipt of the Confirmation sent by FRGK, subject to payment of the amounts due at the time of booking in accordance with the terms stated in the conditions displayed during booking.

5.2 Booking direct, with no platform fees

Booking on our website is free of platform fees. The price shown at the time of booking is the price offered directly by FRGK.

5.3 Group size and composition

The number of guests must not exceed the property’s maximum occupancy. Any change to the group must be notified to us in advance. FRGK may refuse access to guests who exceed the permitted occupancy.

5.4 Accuracy of information

The Client agrees to provide accurate and complete information. The Client must be of legal age and have the legal capacity to enter into a contract.

6. Rates

Prices are shown in euros, inclusive of all taxes, for the property, dates and number of guests selected. A price breakdown (nights, any cleaning fees, additional guests, options and services) is provided in the terms displayed at the time of booking and in your Confirmation.

The tourist tax, collected on behalf of the municipality or inter-municipal authority, is added or included as indicated at the time of booking.

Prices may vary depending on the season, events and length of stay. The applicable price is the one confirmed at the time of booking.

7. Payment terms

Payment terms (the amount and due date of the deposit or advance payment, and the date the balance is due) are those stated in the terms displayed at the time of booking and in your Confirmation.

Online payments are secure and processed by our payment provider. Accepted payment methods are shown during booking. FRGK does not have access to your full banking details.

If the balance is not paid by the due date, FRGK may, after sending a reminder that goes unanswered, consider the reservation cancelled by the Client, in which case the cancellation terms set out in Article 10 will apply.

8. Security deposit

A security deposit may be required for each stay. Its amount, form (card imprint, pre-authorisation or payment) and due date are specified in the terms shown at booking and in your Confirmation, along with the timeframe for its return.

The security deposit does not limit your liability. It will be refunded, less any substantiated amounts owed for damage, loss, excessive cleaning or failure to comply with these Terms, within the timeframe stated in your Confirmation. If the cost of the damage exceeds the deposit, the Client remains liable for the difference.

9. Right of withdrawal

Under Article L. 221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation services provided on a specific date or during a specific period. A stay booking is therefore binding once confirmed; only the cancellation terms below apply.

10. Changes and cancellations

10.1 By the Client

All requests to amend or cancel a booking must be submitted in writing tocontact@frgk.fr. Amendments are accepted subject to availability and may result in a price adjustment.

If the Client cancels, the applicable cancellation terms are those displayed at the time of booking and set out in your Confirmation.

A shortened stay or delayed arrival due to the Client does not entitle them to a refund, unless otherwise specified in the Confirmation.

We recommend that the Client take out cancellation insurance and holiday rental liability insurance.

10.2 By FRGK

If FRGK has to cancel the booking before the start of the stay, except in cases of force majeure or Client default, the Client will receive a full refund of all amounts paid. If the Client wishes, FRGK will endeavour to offer alternative accommodation of an equivalent category, subject to availability.

10.3 Force Majeure

Neither party shall be held liable for any failure to perform resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code. The financial consequences of cancellation due to force majeure are set out in the terms displayed at the time of booking and in your Confirmation.

11. Check-in, check-out and property inspection

Check-in and check-out times, as well as key handover arrangements (in-person welcome or self check-in), are specified in your Confirmation and in the information sent before your stay. Any arrival or departure outside these times requires prior approval and, where applicable, is subject to the terms communicated.

An inventory and condition report may be completed on arrival and departure. Any issue found on arrival must be reported to our team immediately; if the Client does not promptly report any reservations, the accommodation will be deemed to have been delivered in good condition and as described.

The Guest may be asked to provide proof of identity upon arrival.

12. Use of the Property

The Client agrees to occupy the property “as a responsible tenant”, that is, reasonably, peacefully and in keeping with its intended use, and to return it in the condition in which it was found. In particular:

  • comply with the maximum occupancy and any house rules or condominium regulations provided;
  • respect the peace and quiet of the neighborhood; parties and events are not permitted without prior written consent from FRGK;
  • no smoking inside the accommodation, unless otherwise stated in the property listing;
  • only allow pets if the property listing or Confirmation authorizes it;
  • not sublet the property or transfer the booking to a third party;
  • report any breakdown, damage or incident to our team without delay;
  • allow access to the property for any urgent or scheduled work.

In the event of a serious breach (exceeding the permitted occupancy, nuisance, significant damage, or misuse), FRGK may end the stay without a refund, without prejudice to any claim for damages.

Pools & Amenities

Swimming pools, spas and hot tubs are used at guests' own risk. Children must be supervised by an adult at all times. Safety devices must remain in place and be closed again after each use.

13. Concierge services

FRGK provides guests with a concierge service available 24/7 during their stay, complemented by a phone line assisted by an AI voice assistant at +33 4 80 16 16 11 (7 days a week, 24 hours a day).

Optional services may be available on request and subject to availability (daily housekeeping, a private chef, grocery shopping, transfers, a day on a yacht, massages, late check-in and check-out, and a cot). Prices and terms are provided before any order is placed and confirmed in writing. Some services may be provided by partner companies.

14. Liability

FRGK will take all reasonable steps to ensure that the accommodation matches its description and that your stay runs smoothly. It cannot be held liable in the event of:

  • temporary outages or interruptions to external services (water, electricity, internet, public works or neighbourhood works) beyond its control;
  • loss, theft or damage to guests’ personal belongings;
  • damage resulting from failure to comply with these Terms or misuse of the equipment.

If you notice any issue during your stay, you must inform our team immediately so we can resolve it.

The Client is responsible for any damage caused by them or their guests during their stay. They are advised to check that their holiday rental is covered by personal liability insurance.

15. Complaints

Any complaint relating to your stay must be submitted to FRGK, preferably during your stay to allow us to resolve it quickly, and as soon as possible after your stay ends, by email to contact@frgk.fr.

16. Personal Data

Personal data collected when you book is processed in accordance with our Privacy Policy.

17. Governing law and disputes

These Terms and Conditions are governed by French law. In the event of a dispute, the parties will first seek an amicable resolution. Failing that, the dispute will be brought before the competent courts as provided by law; a consumer Client may, in particular, bring the case before either the court where they lived when the contract was concluded or the court where the harmful event occurred.

If these Terms are translated, the French version shall prevail.
